Description: BitSpirit is a very powerful and easy-to-use BitTorrent client that provides not only full BitTorrent protocol implementation but also many personalization features. BitSpirit supports simultaneous downloads, download queue, UPNP port-maping, NAT traversal(UDP transport), select downloads from multiple files torrent package, disk cache, chatting with other peers, torrent market, ip-filter, etc. In 3.0 or above versions of BitSpirit, it also supports DHT network - which is based on Kademlia protocol - and fully compatible with Bittorrent official client.

And I dont talk about uTorrent, here.
This is an better software than uTorrent! Point.

How about Opera, TeamViewer, AniFX, Fotografix, Skype, etc.
These ARE NOT OPEN SOURCE!!!!!!!!!!!!!!!!!!!!!!!

None of these examples are hosted on SourceForge. TeamViewer is hosted on teamviewer.com, and the rest are on downloads.portableapps.com. You may not distribute closed source software on SourceForge. It's against the terms of service.

Concerning online installers, read the documentation on it, which is in the PAF spec.

I have the accept of the owners and I maked it portable.
A lot of portable apps, hosted on portableapps account on sourceforge ARE NOT OPENSOURCE, and that software is IN THE SAME SITUATION.

Anyway, a message for downloaders:

If you can't download it from here, try on the official site: www.bitspirit.cc/en/ because it will be apear portable in some days.

You may not host it on SourceForge. With online installers, the part on SourceForge is open source. Our bundled freeware downloads are not on SourceForge. You will need to remove it from SourceForge.

If you get permission to distribute a freeware product, please state that in your original post. (Preferably with an excerpt of the notification of permission as well.)

Two of your other apps,

Two of your other apps, BitShare.com Desktop Tool and Multiupload Batch Uploader are hosted on SourceForge but are not Open Source. You may have permission for both of those, and probably for this app as well, but as Chris has stated above you cannot host freeware on SourceForge as it is against their terms of service.

Whether you get it hosted on the site of the original app or somewhere else, it just can't be on SourceForge.

or the author of program don´t bother about (yes or not) to portabilize. Certainly He´s not against of it.

That maybe right. A simple note - best but imho not required with a short quote of the answering mail/forum post of the original developer etc. - in the release info would have clarified that.
That still leaves the sourceforge issue.
Both are easy to sort out as can be seen in many other dev tests...

Hi!

I discussed with SourceForge Support. I am allowed to keep it there.
And in the one old request (2yrs+), is writed something like that: "can we make it portable" (I don't remember exactley). And it has no answer...

SourceForge.net has a strict policy for only allowing Open Source applications on their servers. Are you sure the SourceForge.net support team acknowledged that BitSpirit is freeware before they gave you permission?

Yes, they accepted, BUT I need to reveal the readme file in all folders I have portable apps. Is like you use an SDK. You need the main app to run that code. And that main app (of SDK) can be Private Source.

Permission your only good claim

I don't believe that it's basically compatible with their Terms of Service without explicit written permission from Geeknet.

I do not believe that it morally constitutes satisfaction of option (a), though legally it is possible that it might (I think a pack of lawyers would be quite happy to argue about it for a few months if you paid them to do it). Option (b) is obviously not satisfied. Option (c) is what you are claiming; I would like proof of this, indicating that (i) they give permission, and (ii) they understand the situation fully.

Are you forming an argument from silence, or do you have explicit permission? If you don't, then I believe you are violating the Terms of Service and should remove the files.

I believe, and I am sure Chris will correct me if I am wrong, He is just trying to help. Sourceforge is a large group, they may not fully understand what it is they are "agreeing" to. The crux of the issue is that the program is now posted here, on PortableApps. So not only does it have to be ok with them it also needs to be ok with the rules set forth here. That is why I initially asked the question about hosting.

BTW not nice to tell a site admin to "Shut up" especially when they are trying to assist.

in short, only open-source applications can be distributed on sourceforge, your application included a closed source application thus can not be allowed on sourceforge, the application process on sourceforge I'll admit is lax but the rules are rules, so while you may have permission from bitspirit developers to include the application it would still violate the rules of sourceforge, my suggestion is to use a different method of sharing the application.
Maybe ask the bitspirit team if you could work with them to host it themselves thus making it portable using the portableapps.com method but keeping it legal at the same time. it's just a thought.

Simple solution

There's a simple solution to this: just quote for us the email you sent to sourceforge, and their response. You can take out the email addresses, it's just the content that's needed.
