They haven't done anything yet. Just announced that they're going to do something at some point in the future. And they still own the trademark. So nothing has changed in relation to OpenOffice.org Portable yet. Anyone packaging it portably is still doing so illegally.
This has been discussed in a couple other threads already.
Sometimes, the impossible can become possible, if you're awesome!
