I just copied and pasted the description off of some website that apparently didn't care about the meaning of OSS, and they were simply referring to the fact that it was cost-free. You are correct, it's licensed under the GPL (not sure which version, but probably GPLv2).

Be sure to checkout the 0.9.4+ Version.

You should just be able to drop the .exe in the /App/DeSmuME directory and either rename it or else use the DeSmuMEPortable.ini in the /Other/Source folder to point it to the new .exe (you have to move the .ini into the same folder as DeSmuMEPortable.exe). Give it a try and let me know if the .ini is working properly, it'd be a great chance to test it

Ini ´s working proberly. DeSmuME 0.9.4+ is the same like the normal .exe, but with Lua support.
can you update to 0.99?
