Due to the way open source works, it is not illegal, as long as they don't use portableapps.com logos. I use a mod of the platform, called PAM MOD Patch3d, and it is perfectly legal. Even logo removal is legal.

If you're gonna be making a competing product, you can't use our graphics either. It's part of the PortableApps.com trade dress. We've let the MODs do it (with our logo intact) until the main platform gets a few of the features it's lacking.

I actually think a lot of people would be interested in the menu without the PA.c logo, or at least the option to hide it. The logo isn't part of the theme, it's drawn separately over the theme, so a theme creator must leave that area blank so as not to have part of the theme's design hidden by a logo over it.
No offense at all meant to PA.c, but being able to hide the logo would open the door to more creative themes, as other logos could be placed up there. I wouldn't mind a stylized print of my name up there, for example.
Of course this is not something that would be turned on by default, but rather just be there for the power users. Heck, don't even put it in the GUI, make it so if you add to an INI, DisplayLogo=False, would turn it off, that would be fine. Because then it wouldn't be hard for me to take any theme I have, write my name in some cool font, and add that to the theme's background. Maybe even have my contact info up there, in case the flash drive gets lost and somebody (honest) finds it.
Yup, its really nice, but you should know that it is hard to make an application like this, so i think its okay they have their own logo, its a free application, so dont mind it

In any case, the software is open-source, which means that anybody can edit the source code and change it as they see fit, they just have to follow a couple simple and hardly restrictive guidelines, and say where they got the code. While unnecessary, it's also a common courtesy to let them know what you're doing with their code. That's just the nature of open source, and if developers didn't want their application messed with, they wouldn't be into open source. You can still have freeware without open source; it's done all the time. CCleaner is a good example that comes immediately to mind.
Two examples of modifications to JTH's menu also come to mind. First, a site we're really not supposed to talk about, but we can jokingly call it PortableCrapz, last I heard. They package illegal software as portable and their site is kind of a parody of this one. They took the menu, removed the logo, and put their own up there. Aside from their logo being a cheap knockoff of this site's logo and had they used their own, original logo, that in and of itself would be acceptable under and open source license. Second, the R34 mod mentioned earlier in the topic. It removes the logo altogether and adds a ton of nice features still unmatched by the current menu, and it's a year and a half old. That's also acceptable under open source rules. (See also: Geek.menu.)
So you posting an alternate version without the logo is perfectly acceptable, though, if I am wrong, JTH or one of the mods can correct me as they see fit. I believe I understand the basics, but I am still learning in the world of open-source, myself.
Nathan the link you posted is for R34,not the Patch3d that NulltrilizeD mentioned.
Unless they are both the same and NulltrilizeD got the name wrong.
Perhaps this explains why I couldn't find it when I Googled Patch3d.

Nope, it my mod, and it have original feature in 1.5.2, its different from R3 patch,ill releasing 1.6 beta soon without logo. ( meant only screenie )

According to Google there's no such thing as "PAM MOD Patch3d". So if somebody has it, they haven't shared it online. I believe it's a typo for the R34, the current version of which is here. Can't seem to edit the other post.

But while I do agree that portability is one of the greatest innovations in the software world, I disagree that not displaying the logo is in any way a sign of disrespect. Running the Blahspot version of the menu, on the other hand...
