Why hasn't this been made official yet?
I checked out this app for going official and it includes copyrighted music taken from Super Mario Brothers. As there is no mention of this on the publisher site, it would appear this is being done without permission. Making a play-alike of a game is just fine. Even recreating play and similar graphics. But directly using copyrighted works without permission is iffy at best (and outright copyright infringement, more realistically). Is there any way we can get the publisher to remove copyrighted elements or can we swap out the infringing music for legit music?

I used to contribute graphics for this game and recently started back up again. I will check on the music to see what still needs replaced in the game. I know a year ago, there was a big push to remove/replace all items that were not copyright compliant but I don't know what else remains from that effort.
bossbattle_3.ogg, cave_3.ogg and land_3.ogg have cover art from Looney Tunes Space Race for the Dreamcast, so they could very well be direct rips from those games.
hyper_1.ogg has cover art from Dynasty Warriors 4 for PC
Additionally, several of the files are basically recreations of the music from SMB created by others. menu.ogg, jungle_1.ogg and default_story_1.ogg are a few examples. Even re-recording your own version of a song doesn't somehow avoid the original author's copyright. I'm unsure how Nintendo would handle these instances as they seem a bit lax in terms of recreation for music's sake (when bands do these) but they may have an issue when it is used in a video game, especially a mario-style video game.

I listened to all the sounds yesterday, and while I'm not familiar enough with some of them to know off the cuff if they are/aren't, there are some that are definite.
Interestingly (and I'm going to have to do some more research) things like Menu.ogg and default_story_1.ogg are from cover-album "SMW" by Jason Cox (XOC Music) - similar to what you mentioned about band's doing covers. So, I'll keep digging on the other end to see if we can find something from the past history that allows their use.
I've been working with the long-time developer of the game and he does have permission from Jason Cox to use those tracks in the game. So now we're back to the original question - does using someone else's published cover album of the original SMB music constitute a copyright violation?
I will continue working on replacing the other sounds that you mentioned, John, but perhaps you know someone who could give some better feedback on the other question.

I check at Travis Carrico info(the developer of the tester), he has mail, so you can write an email, and maybe he will send you a newer version of maryo
That's not needed, I have the correct files. I'm not sure if I have to include the background music with the game, the site (http://www.secretmaryo.org/index.php?page=game_download_windows&sid=?sid=) says that it's an extra download and there also was some discussion here before. Should I add them or not?
I already updated the launcher. I've made few apps portable for my own use, but never published any of them. I'm not sure whether the files are in the right location.
btw: Do I have to make a new thread next to this one or post it in here?
